On April 25, New York’s Supreme Court of Appeals overturned the conviction of producer Harvey Weinstein. He was jailed for harassment and sexual assault following his 2020 conviction.
According to the appeal court, the trial judge caused damage to the producer with illegal decisions that became egregious. This also applies to women being allowed to testify about allegations that were not part of the case.
The court’s decision states that the judges concluded that the first instance erroneously took into account evidence of previous sexual relationships with persons other than those who alleged the underlying crimes.
The appeals court ruled that Harvey Weinstein did not receive a fair trial. After all, he was tried not only for the crimes he was accused of, but also for his past behavior. So now the district attorney must decide whether he will seek a retrial of the producer’s case.
